Welcome to karismaticphotos.com (the “Site”), operated by Karismatic Photos, a photography business owned by Karah Sommer and based in Severance, Colorado. By accessing or using this Site, you agree to be bound by these Terms of Service (“Terms”). If you do not agree with any part of these Terms, please discontinue use of the Site.

Use of This Website

This Site is provided for informational purposes and to facilitate contact between prospective clients and Karismatic Photos. You agree to use this Site only for lawful purposes and in a manner that does not infringe upon or restrict the use and enjoyment of this Site by others. You may not use this Site to transmit harmful, threatening, abusive, or otherwise objectionable material.

Intellectual Property

All content on this Site, including but not limited to photographs, text, graphics, logos, page layout, and design, is the property of Karismatic Photos and Karah Sommer and is protected under United States copyright law. Unless otherwise stated in a signed client contract:

• All photographs displayed on this Site are copyrighted works of Karah Sommer / Karismatic Photos.
• You may not reproduce, distribute, modify, display, or create derivative works from any content on this Site without prior written consent.
• Clients who have booked a session receive a personal-use license for their delivered images as outlined in their individual photography contract. This license does not extend to images displayed on this Site that belong to other clients.

Portfolio and Model Release

Photographs featured on this Site may include images from past client sessions displayed with permission. I reserve the right to use images from client sessions for portfolio display, social media, and marketing purposes unless a client has opted out in writing prior to or at the time of their session. If you recognize yourself in a photograph and wish to have it removed, please contact me at karismatic.photos@gmail.com.

Inquiry and Contact Submissions

When you submit an inquiry through this Site, you acknowledge that the information you provide (name, email, phone number, session preferences, and message) will be collected and stored for the purpose of responding to your request. Submitting an inquiry does not create a binding contract or guarantee session availability. Booking is confirmed only upon execution of a signed photography contract and receipt of a retainer payment.

Session Booking and Cancellation

The terms of individual photography sessions, including pricing, deliverables, timelines, retainer policies, and cancellation terms, are governed by the signed photography contract between you and Karismatic Photos. General policies include:

• Retainers are non-refundable and are applied toward the total session cost.
• Sessions may be rescheduled with at least 48 hours' notice at no additional charge.
• Rescheduled sessions must take place within 6 months of the original booking date.
• Weather-related rescheduling is handled at no extra cost with advance communication.

These are general guidelines. Your signed photography contract takes precedence over any information stated here.

Pricing and Availability

Session packages and pricing listed on this Site are subject to change without notice. Prices are confirmed at the time a photography contract is signed. Published prices reflect current standard offerings and may not include travel fees, additional hours, or add-ons. All quoted prices are in US Dollars.

Limitation of Liability

This Site and its contents are provided “as is” and “as available” without warranties of any kind, either express or implied. Karismatic Photos shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use of or inability to use this Site. This includes but is not limited to damages resulting from errors, interruptions, loss of data, or unauthorized access to the Site.

This Site may contain links to third-party websites such as Instagram and Facebook. These links are provided for convenience and do not constitute endorsement. Karismatic Photos is not responsible for the content, privacy practices, or terms of any external websites. You access third-party sites at your own risk.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Weld County, Colorado.

I reserve the right to update or modify these Terms at any time. Changes will be reflected by the effective date at the top of this page. Continued use of the Site following any modifications constitutes your acceptance of the revised Terms.
